Resalta la Corte que las leyes orgánicas, según la prohibición prevista en el numeral 10 del artículo 150 C.P., son siempre leyes en sentido formal, es decir, expedidas por el Congreso, jamás por el Presidente de la República. En cambio, nada se opone a que los estatutos orgánicos de las entidades públicas, cuyo contenido es especifico y totalmente diferente, están contemplados en el numeral 7 del artículo 150 de la Carta, puedan ser objeto de facultades extraordinarias, pues no se hallan cobijados por la prohibición del numeral 10 Ibídem.
